Terms of Service
These Terms of Service ("Terms") are an agreement between you and Daniel Hariyanto, operating as Caddie ("Caddie", "we", "us", "our") and govern your use of the Caddie iPhone application and related services (the "Service"). By accessing or using the Service, you agree to be bound by these Terms.
1. Eligibility
You must be at least 13 years old (or 16 in jurisdictions where that is the applicable threshold) and able to form a binding contract under applicable law. By using the Service, you represent that you meet these requirements.
2. Your account
You access the Service by signing in with Apple. You are responsible for keeping your Apple account secure and for all activity that occurs under your Caddie account. Notify us at hey@heycaddie.app if you suspect unauthorized use.
3. License to use the Service
Subject to these Terms, Caddie grants you a personal, non-exclusive, non-transferable, revocable license to install and use the Service on Apple-branded devices you own or control, as permitted by the Apple Media Services Terms and Conditions. You may not sublicense, rent, lease, sell, or otherwise transfer the Service or your account.
4. Subscriptions and billing
The Service offers paid subscription tiers ("Trial", "Pro", "Max"). All purchases are processed by Apple through the App Store and are governed by Apple's standard terms.
- Free trial. A free 3-day trial of the Pro tier is offered to first-time subscribers. If you do not cancel before the trial ends, your subscription will automatically convert to a paid Pro subscription at the then-current price. You can cancel during the trial without charge.
- Auto-renewal. Subscriptions auto-renew at the end of each billing period (monthly or annual, as selected) unless canceled at least 24 hours before the renewal date. You can cancel any time in iOS Settings → [Your Name] → Subscriptions.
- Refunds. Refunds are governed by Apple's refund policy. To request a refund, visit reportaproblem.apple.com. Apple determines whether to grant a refund.
- Price changes. If we change our prices, we will notify you in advance through the App. Continued use after a price change constitutes acceptance of the new price.
- Token usage caps. Each tier includes a monthly token usage cap (currently: Trial — 500K tokens; Pro — 12M tokens monthly / 20M tokens monthly for annual; Max — 28M tokens monthly / 40M tokens monthly for annual). If you reach your cap, Caddie may pause certain operations and offer you the option to upgrade or wait until your next billing cycle. We may adjust caps from time to time and will notify you in advance of material changes.
- Workspace storage caps. Each tier includes a workspace storage limit (currently: Trial — 4GB; Pro — 32GB; Max — 64GB). If you reach your storage limit, Caddie will pause new uploads and offer you the option to upgrade or remove existing files. We may adjust storage limits from time to time and will notify you in advance of material changes.
- Family Sharing. Where supported by Apple, the Pro tier may be shared via Apple Family Sharing.
5. Acceptable use
You agree not to:
- Use the Service for any illegal, harmful, or fraudulent purpose;
- Instruct Caddie to violate any law or third-party right;
- Attempt to reverse engineer, decompile, disassemble, or otherwise derive the source code of the Service or the underlying models;
- Interfere with or disrupt the Service or its infrastructure, including by transmitting malware or excessive automated requests;
- Use the Service to generate content that is illegal, defamatory, harassing, infringing, sexually explicit involving minors, or that violates the rights of others;
- Resell, sublicense, or commercially exploit the Service without our written permission;
- Use the Service in any manner that violates the Apple Media Services Terms and Conditions or App Store Review Guidelines.
6. Your responsibility for Caddie's actions
Caddie acts on your behalf. When you instruct Caddie to take an action — send an email, schedule a meeting, modify a file, post a message, run code, browse a website — you are responsible for that action and its consequences. You should review and confirm sensitive or high-stakes actions before they are executed. Caddie is not liable for the consequences of actions you direct it to take.
7. Your content
You retain ownership of all content you provide to Caddie ("Your Content"), including messages, uploaded files, integration data, and other input. You grant us a limited, worldwide, non-exclusive, royalty-free license to host, store, transmit, and process Your Content solely as necessary to provide the Service to you.
We do not use Your Content to train artificial intelligence models, our own or those of any third party.
8. AI outputs
Caddie's responses are generated by artificial intelligence models. These outputs may contain inaccuracies, errors, or content that is incomplete, misleading, or out of date. You are responsible for reviewing and verifying Caddie's outputs before relying on them, particularly for decisions with legal, financial, medical, employment, safety, or other significant consequences. The Service is not a substitute for professional advice.
9. Intellectual property
The Service, including its software, design, branding, and the underlying technology, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you any rights in our intellectual property except for the limited license to use the Service described above.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS, OR THAT THE OUTPUTS WILL BE ACCURATE, COMPLETE, OR RELIABLE.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL CADDIE, ITS OPERATORS, OR ITS LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICE IN ANY 12-MONTH PERIOD IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THAT PERIOD OR (B) FIFTY UNITED STATES DOLLARS ($50 USD).
12. Indemnification
You agree to defend, indemnify, and hold harmless Caddie and its operators from any claim, demand, loss, liability, or expense (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, your violation of any third-party right, or any action you direct Caddie to take.
13. Termination
You may stop using the Service at any time and may delete your account through the iOS app. We may suspend or terminate your access if you violate these Terms or if continued use poses a risk to us, our users, or third parties. Sections that by their nature should survive termination (including disclaimers, limitation of liability, indemnification, and intellectual property) will survive.
14. Governing law and disputes
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws principles. You agree to resolve any disputes in the state or federal courts located in San Francisco County, California, and waive any objection to jurisdiction or venue. Nothing in this section prevents you from seeking relief from a small-claims court in your own jurisdiction where applicable.
15. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated by in-app notification or email at least 7 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
16. Apple-specific terms
The following terms apply because the Service is licensed through the Apple App Store and are required by Apple. They apply only to your use of the Service on Apple-branded devices.
- Acknowledgment. These Terms are between you and Caddie only, and not with Apple Inc. ("Apple"). Apple is not responsible for the Service or its content.
- Scope of license. Apple grants you a non-transferable license to use the Service on any Apple-branded device that you own or control, as permitted by the Apple Media Services Terms and Conditions.
- Maintenance and support. Caddie is solely responsible for providing maintenance and support for the Service. Apple has no obligation to furnish any maintenance or support services with respect to the Service.
- Warranty. Caddie is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Service. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the Service.
- Product claims. Caddie, not Apple, is responsible for addressing any claims by you or any third party relating to the Service or your possession and/or use of the Service, including (a) product liability claims; (b) any claim that the Service fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer-protection, privacy, or similar legislation.
- Intellectual property rights. In the event of any third-party claim that the Service or your possession and use of the Service infringes that third party's intellectual property rights, Caddie (not Apple) will be solely responsible for the investigation, defense, settlement, and discharge of any such claim, to the extent required by these Terms.
- Legal compliance. You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Third-party beneficiary. You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
